Terms of Service

1. Agreement to Terms

By accessing or using Inxtruc ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

Inxtruc is a mobile-first platform for creating visual, step-by-step guides for short-term rental guests. These terms govern your use of our website at inxtruc.com and our application at app.inxtruc.com.

2. Description of Service

Inxtruc provides a platform that allows short-term rental hosts to:

  • Create visual guides with photos and text instructions for their properties
  • Organize guides by spaces (properties) and groups
  • Share guides with guests via QR codes or links (no app required for guests)
  • Access guide analytics to track views and guest engagement
  • Use offline viewing capabilities for guests

3. Account Registration

3.1 Account Creation

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3.3 Organizations

Accounts are associated with organizations. Organization owners and administrators can invite team members and manage access levels. You are responsible for the actions of all users within your organization.

4. Subscription and Payment

4.1 Pricing Plans

Inxtruc offers the following subscription tiers:

  • Free: Limited to 1 space and 3 guides
  • Starter: Up to 5 spaces and 30 guides
  • Pro: Unlimited spaces and guides

4.2 Add-ons

Additional features are available as add-ons on paid plans, including extra spaces, extra guides, and custom domain support.

4.3 Billing

Paid subscriptions are billed monthly or annually through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. Prices are subject to change with 30 days notice.

4.4 Refunds

Subscription fees are non-refundable except where required by law. If you cancel your subscription, you will retain access to paid features until the end of your current billing period.

5. User Content

5.1 Your Content

You retain ownership of all content you create and upload to Inxtruc, including photos, text, and guide content ("User Content"). By uploading content, you grant us a non-exclusive license to store, display, and distribute your content as necessary to provide the Service.

5.2 Content Responsibility

You are solely responsible for your User Content. You represent and warrant that:

  • You own or have the necessary rights to use and share your User Content
  • Your User Content does not infringe any third party's intellectual property rights
  • Your User Content does not contain illegal, harmful, or offensive material
  • Your User Content does not violate any person's privacy rights

5.3 Content Removal

We reserve the right to remove any User Content that violates these terms or is otherwise objectionable, without prior notice.

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Upload content that is defamatory, obscene, or violates others' rights
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers/networks connected to it
  • Use automated means to access the Service without our permission
  • Resell or redistribute the Service without authorization
  • Share your account credentials or allow others to access your account
  • Use the Service to send spam or unsolicited communications

7. Intellectual Property

7.1 Our Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by Inxtruc and are protected by international copyright, trademark, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal or business use as a short-term rental host.

8. Third-Party Services

The Service integrates with third-party services including:

  • WorkOS: For authentication and user management
  • Stripe: For payment processing
  • Vercel: For hosting and media storage

Your use of these services is subject to their respective terms of service and privacy policies.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

We do not guarantee that guides shared with guests will always be accessible or that offline functionality will work in all circumstances.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INXTRUC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from these terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Inxtruc and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your User Content, or your violation of these terms.

12. Termination

12.1 By You

You may terminate your account at any time by contacting us or using the account deletion feature in the application. Upon termination, your right to use the Service will immediately cease.

12.2 By Us

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these terms. Upon termination, your User Content may be deleted.

13. Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of significant changes by posting on the Service or sending you an email. Your continued use of the Service after changes take effect constitutes acceptance of the new terms.

14. Governing Law

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Inxtruc is incorporated, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

16. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
